Felon arrested with loaded firearm

On June 9, 2021 at 8:32 p.m., Menlo Park Police contacted 26-year-old Niko Brain of East Palo Alto during an investigation of falsely displayed license plates.  During the contact, Brain became agitated and attempted to flee from the officers.  Officers attempted to restrain Brain and during the struggle, one of the officers felt Brain reaching for his waistband. As the struggle continued, another officer located a handgun concealed in Brains’ waistband.  

Officers, on scene, were able to take Brain into custody without injury to him or the officers, and they safely retrieved the loaded firearm from Brains’ waistband.    

Brain was booked into San Mateo County jail with the following charges stemming from the incident.

  • Felon in possession of a firearm - 29800(a)(1) PC
  • Carrying a loaded firearm with prior felony conviction -  25850(c)(1) PC
  • Carrying a loaded firearm / gang member - 25850(c)(3) PC
  • Carrying a concealed firearm with prior conviction - 25400(c)(1) PC
  • Carrying a concealed firearm / gang member - 25400(c)(3) PC
  • Obstructing / resisting officer - 69 PC
  • Possession of firearm without serial number/ identification mark - 23920 PC
