Project Description

The applicant, O'Brien at Derry Lane, LLC, is proposing to construct a mixed-use development consisting of 108 for-sale housing units and 24,925 square feet of commercial space. The project area comprises 3.45 gross acres on the north side of Oak Grove Avenue between the Caltrain tracks and the commercial properties fronting El Camino Real. The property is currently used for a variety of small retail and service activities, which would be demolished, and for automobile storage, which would be eliminated.

The project requires the following applications:

Rescind Previous Approvals and Pursue New Approval for a General Plan Amendment, Zoning Ordinance Amendment, Rezoning, Planned Development Permit, Major Subdivision, Development Agreement, BMR Agreement, Heritage Tree Removal Permit, and Environmental Review

Required Review

The revised project requires review by the Housing Commission and Planning Commission, and review and approval by the City Council.

The Planning Commission last reviewed this project on March 31, 2008.

Current Status

This project is currently on hold at the request of the applicant.

On August 29, 2006, the Derry Lane Mixed Use Development, which included 135 residential units and 22,525 square feet of commercial space, was approved by the City Council, and on September 12, 2006, the City Council adopted the ordinances amending the Zoning Ordinance and rezoning the property to Planned Development (P-D). In October 2006, a referendum petition was submitted to the City.

In May 2007, the applicant for the Derry Lane project and the referendum group announced a settlement. In September 2007, staff received plans for the revised project. In February and March 2008, staff received further revised plans addressing comments from staff. A staff report has been issued for the March 31, 2008 Planning Commission meeting. An Addendum to the previously certified Final EIR has been prepared and is attached to the staff report. The Addendum concludes that the revised project would not result in new or more significant impacts (or require new or significantly altered mitigation measures) beyond those already identified in the Final EIR.

The Housing Commission reviewed the revised project during its March 5, 2008 meeting, and recommended approval of the BMR Agreement.
